Welcome to My First Holy Communion Website terms and conditions. These terms
and conditions apply to the use of this Website and by accessing this Website
and/or placing an order you agree to be bound by the terms and conditions set
out below. If you do not agree to be bound by these terms and conditions you
may not use or access this Website.

a product displayed for sale on the Website; “product Description” means
that part of the Website where certain terms and conditions in respect of the
individual Product are provided; “Special Conditions” means the

Privacy and Security
We are committed to protecting your privacy. We will treat all your Personal
Information as confidential (although we reserve the right to disclose this
information in the circumstances set out below). We will keep it on a secure
server and we will fully comply with all the applicable UK Data Protection

Information is collected through the ordering process so that your order can
be processed. We will not forward your details onto any third parties without
your consent with the exception of our secure payment service provider at the
time of ordering to enable payment to be taken and your order processed.
Any communication between you and WorldPay is encrypted to the maximum strength
supported by your browser using TLS or 128 Bit SSL. Data storage on WorldPay
systems, and the communication between WorldPay and the worldwide banking networks,
is regularly audited by the banking authorities to ensure a secure transaction
environment. Worldpay also ensure that they stay up-to-date with the latest
versions of any third-party code they use, and continually review their own
proprietary code.
Shopping with My First Holy Communion is SECURE because we use industry standard
SSL (Secure Sockets Layer) technology to protect your sensitive information.
This means that all your information, including your credit card number, name
and address cannot be read as the information travels over the internet.
Your credit card transactions are encrypted for your protection to ensure
that your details are completely secure. A secure line is established via your
own computer prior to you entering any sensitive information. You will then
notice the yellow padlock or key image at the bottom of your browser. This
verifies you are using a secure line.
Once your payment has been accepted, your credit card details are deleted.
This means you will need to provide your credit card details each time you
place an order. Re-assurance that we do not hold your sensitive information.
General
Intellectual property and right to use
You acknowledge and agree that all copyright, trademarks and all other intellectual
property rights in all material or content supplied as part of the Website
shall remain at all times vested in us or our licensors. You are permitted
to use this material only as expressly authorised by our licensors or us.

Colour Representation
My First Holy Communion cannot be held responsible for poor colour representation
as no guarantee can be made for colour monitors not accurately representing
the colour of the garment/product.
Accuracy of Content and Compliance to Local Laws
My First Holy Communion cannot be held liable for the accuracy of content and
all supported material on this website, nor for those accessing the website
outside of the United Kingdom. Please be made aware that you are responsible
for any local compliance to all local laws that may be applicable in the
Country of use.
Customs
When exporting items out of the Country, charges cover postal and delivery
costs only. Unfortunately, My First Holy Communion are unable to advise amounts
of import duties that may be payable by our Overseas customers, nor are we
able to accept responsibility for these duties.
It is sometimes necessary for Customs to inspect items prior to receipt. Unfortunately,
this may cause a delay and this is also out of our control.
Computer Viruses
My First Holy Communion cannot be held liable for any loss or damage caused
by computer viruses. Every effort is made to ensure all e-mail messages are
sent using the most efficient, up-to-date virus scans. You should therefore
ensure you carry out your own virus protection checks.
Availability
All items are subject to availability and all prices quoted on this site are
correct at the time of publication. My First Holy Communion cannot be held
liable for items that are out of stock. We make every effort to ensure items
are available. However, due to our stock being in limited sizes and quantities
and most, only being available for one season, certain items may not be repeated
or available.
Limitation of liability
While we will use reasonable endeavours to verify the accuracy of any information
we place on the Website, we make no warranties, whether express or implied
in relation to its accuracy. The Website is provided on an "as is" and "as
available" basis without any representation or endorsement made and we
make no warranties of any kind, whether express or implied, in relation to
the Website, or any transaction that may be conducted on or through the Website
including but not limited to, implied warranties of non-infringement, compatibility,
security, accuracy, conditions of completeness, or any implied warranty arising
from course of dealing or usage or trade.
To the fullest extent permissible under applicable law, we disclaim any and
all warranties of any kind, whether express or implied, in relation to the
Products. This does not affect your statutory rights as a consumer, nor does
it affect your Contract Cancellation Rights.
We will not be liable, (including, without limitation, negligence), pre-contract
or other representations (other than fraudulent or negligent misrepresentations)
or otherwise out of or in connection with the Conditions for:
any economic losses (including without limitation loss of revenues, profits,
contracts, business or anticipated savings); or any loss of goodwill or reputation;
or any special or indirect losses suffered or incurred by that party arising
out of or in connection with the provisions of any matter under the Conditions.
Nothing in the Conditions shall exclude or limit our liability for death or
personal injury resulting from our negligence or that of our servants, agents
or employees.
Severance
If any part of the Conditions shall be deemed unlawful, void or for any reason
unenforceable, then that provision shall be deemed to be severable from the
Conditions and shall not affect the validity and enforceability of any of
the remaining provisions of the Conditions.
Waiver
No waiver by us shall be construed as a waiver of any proceeding or succeeding
breach of any provision.
Survival
Each provision of the Conditions shall be construed as separately applying
and surviving even if for any reason one or other of those provisions is
held to be inapplicable or unenforceable in any circumstances.
Entire agreement
These Conditions govern our relationship with you. Any changes to these Conditions
must be in writing and signed by both parties. In this way, we can avoid
any problems surrounding what we and you are expected to do. You confirm
that, in agreeing to accept the Conditions, you have not relied on any representation
save insofar as the same has expressly been made a term of these Conditions
and you agree that you shall have no remedy in respect of any representation.
These terms and conditions do not affect your Statutory Rights. Nothing in
this Clause shall limit or exclude our liability in respect of any fraudulent
or negligent misrepresentation whether or not such has become a term of the
Conditions.
You should be aware that if we are requested by the police or any other regulatory
or government authority investigating suspected illegal activities to provide
your Personal Information and /or User Information, we are entitled do so.
Force Majeure
We shall not be liable for any delay in performing our obligations under any
agreement of which these Terms and Conditions form part if such delay is
caused by circumstances beyond our reasonable control and we shall be allowed
a reasonable extension of time for the performance of such obligations. These
should include act of God, war, fire, flood, storm, power failure and any
mechanical failure.
Law
The Conditions shall be governed by and construed in accordance with the laws
of England and you irrevocably submit to the exclusive jurisdiction of the
courts of England.

Purchase of products
We will take all reasonable care, in so far as it is in our power to do so,
to keep the details of your order and payment secure, but in the absence
of negligence on our part we cannot be held liable for any loss you may suffer
if a third party procures unauthorised access to any data you provide when
accessing or ordering from the Website.
The technical steps required creating the contract between you and us are
as follows:
You place the order for your products on the Website by pressing the confirm
order button at the end of the checkout process. You will be guided through
the process of placing an order by a series of simple instructions on the Website.
Order acceptance and the completion of the contract between you and us will
take place on the dispatch to you of the Products ordered unless we have notified
you that we do not accept your order, or you have cancelled it in accordance
with the instructions in
Non-acceptance of an order may be a result of one of the following:

Our inability to obtain authorisation for your payment.
·
The identification of a pricing or product description error.
·
You not meeting the eligibility to order criteria set out in the main Terms & Conditions.
The contract will be concluded in English.
Contract cancellation
Please note that you are entitled to cancel this contract if you so wish provided
that you exercise your right no longer than seven working days after the
day on which you receive the Products.

OUR GUARANTEE
We are a small family run business and we pride ourselves on our commitment
to customer service. We hope that you will be delighted with all your purchases
from My First Holy Communion.
However, if for any reason you wish to return an item please refer to our
returns policy below.
Under the Distance Selling Regulations you have the right to cancel your order
within 7 working days of delivery for any unused items that you purchase from
us. In addition, if for any reason you are not happy with your purchase please
return it to us in all its original packaging, unused and in re-saleable condition
within 7 days for a full refund of the product cost.
To return an item please complete the return slip, stating your reason for
return and whether you require an exchange or refund, and enclose with the
item to be returned. Please package the item securely with original labels

We recommend that you use the recorded delivery service to provide you with
proof of delivery. Unfortunately we are not able to reimburse return delivery
costs. However, there is no further Postage and Packaging charge to pay for
exchanging items.

Pricing Information
Please note that all prices are correct at the time of publication. We
do try to maintain prices but it is sometimes necessary to increase or
decrease prices. The price paid at the time of checkout is final and will
not be amended.
